These website terms of use (the “terms of use”) govern your access to and use of the website. the website is available for your use only on the condition that you agree to the terms of use set forth below. This document constitutes a legally binding contract between you, as the seller of goods, Eco Gadgets Eservices Pvt. Ltd. (Ecogadgets), and third-party buyers, which provides services for purchasing, recycling, and/or donating used consumer products (the "buyer services"). Ecogadgets functions as a platform enabling compliant sellers to offer specific goods. Your actual sales and transactions are conducted directly with these third parties, and not with Ecogadgets, unless explicitly and clearly stated otherwise. Consequently, Ecogadgets has no control over any aspect of your sales and transactions with third parties, and these third parties are solely responsible to you for all aspects of your sales and transactions with them. Therefore, Ecogadgets bears no liability towards sellers or buyers in this regard. In this document, "we," "our," and "us" refer collectively to Ecogadgets and its third-party buyers.
1. You attest that you are the legal owner of the gadget you intend to sell.
2. All initial quotes are subject to our evaluation of your gadget, and a binding offer is not made until we have inspected the item. We reserve the right to decline to purchase any item you offer for any reason we deem appropriate in our sole discretion. We also reserve the right to modify our quote at any time.
3. Should you receive a quote via our website/app/affiliates, and upon inspection of your gadget, we agree to pay the quoted amount, you are legally and contractually obligated to sell the gadget to us for that price.
4. Should you receive a quote via our website/app, and upon inspection your gadget is: A) a different model than originally quoted, B) missing any parts, or C) in a different condition than stated, we reserve the right to revise our offer in these and other similar instances.
5. All gadgets sold must be accompanied by the following documents:
a. A self-attested, government-approved ID-proof of the owner of the old gadget.
b. A self-attested indemnity bond provided by us, if required.
6. Lawful Sales Only: You must possess the right, title, and all legal interest in the gadget or other articles you sell to us. Your sale and/or shipment of any such article must not violate any law, regulation, or statute of any jurisdiction. You may not unlawfully transfer or encumber any intellectual property, trademark, copyright, patent, software, license, or other legal right or restriction through the shipping or selling of the picked-up article. The article you sell must be free of all legal restrictions that would affect its value or restrict your legal right to transfer ownership (including the article itself, software present on the article, or hardware on or inside the article). You must adhere to all export laws and restrictions. The article you sell (including all related materials, software, and add-on hardware) may not be counterfeited, stolen, or contain harmful or offensive content of any nature. You agree to indemnify and hold Ecogadgets, our affiliates, suppliers, licensors, partners, and the officers, directors, employees, agents, and representatives of each of them harmless, including costs, liabilities, and legal fees, from any claim or demand made by any third party due to or arising out of (i) your access to or use of the Services, (ii) your violation of these Terms & Conditions.
7. It is your responsibility to wipe, clean, or delete data on your gadget being sold via Ecogadgets. You confirm that all data on the device will be erased before handover. You also confirm that should any data remain accessible due to a technical reason, despite manual/electronic erasure, Ecogadgets or the Third-party buyer will not be responsible, and you will not approach Ecogadgets for data retrieval.
8. You understand that once a device is sold by you via Ecogadgets, it cannot be returned to you under any circumstances.
9. You understand that products distributed as gifts from state-sponsored or NGO-funded distribution programs are not accepted on the Ecogadgets platform.
10. We reserve the right to modify this agreement at any time without prior notice. Your continued use of our website/app, tools, and services following any such modification constitutes your agreement to abide by the Agreement as modified. Terms and conditions modifying the Agreement are effective immediately upon publication.
11. Ecogadgets reserves the right to cancel any transaction deemed suspicious or fraudulent at the organization's sole discretion.
Terms of Use for Product
The Services comprise a technology platform that connects users of Ecogadgets mobile applications or websites, provided as part of the Services, who are seeking gadget (Phones, tablet, Laptop, Smartwatches, Air conditioner, Refrigerator, Washing Machine, etc.) repair services to a network of third-party repair technicians, including independent third-party repair technicians and third-party logistics providers under agreement with Ecogadgets ("Third Party Professionals"). The Services are made available solely for your personal/non-commercial use, unless otherwise agreed upon in writing in a separate agreement with you.
You acknowledge and agree that Ecogadgets does not provide gadget repair services or logistics, nor does it function as a gadget repair services company. Our services are intended for your use, if at all, for the purpose of requesting and scheduling gadget repair or logistics services with third-party professionals. However, you agree that Ecogadgets bears no responsibility or liability to you regarding any gadget repair or logistics services provided to you by the third-party professionals through the use of the services, other than as explicitly stated in these terms.
Ecogadgets does not guarantee the suitability, safety, or ability of third-party professionals. It is solely your responsibility to ascertain if a third-party professional will meet your needs and expectations. Under no circumstances will Ecogadgets participate in disputes between you and a third-party professional. By using the services, you acknowledge that you may be exposed to situations involving third-party professionals that are potentially unsafe, offensive, harmful to minors, or otherwise objectionable, and that your use of third-party professionals arranged or scheduled using the services is at your own risk and judgment. Ecogadgets shall have no liability whatsoever arising from or in any way related to your transactions or relationship with third-party professionals.
Payment for Services
You understand and agree that using the Services may result in payments by you for the services you receive from a Third Party Professional ("Charges"). After you have received services, Ecogadgets will facilitate payment of the applicable Charges on behalf of the Third Party Professional, solely as the Third Party Professional’s limited payment collection agent, using your designated preferred payment method during account initiation or modification. You will receive a receipt via email at the end of each session. By utilizing the Services, it is understood and agreed that payment of the Charges in this manner will be considered equivalent to direct payment by you to the Third Party Professional(s). Charges will include applicable taxes as required by law. Charges paid by you are final and non-refundable, unless otherwise determined by Ecogadgets in its sole discretion. While you retain the right to request lower Charges from a Third Party Professional for services received at the time of service, Ecogadgets will respond accordingly to any request from a Third Party Professional to modify the Charges for a particular service.
You understand and agree that (i) all Charges are due immediately and (ii) payment will be facilitated by Ecogadgets using your designated preferred payment method during account initiation or modification. If your primary account payment method cannot be charged for any reason, you agree that Ecogadgets, as the Third Party Professional’s limited payment collection agent, may use a secondary payment method in your account, if available.
Ecogadgets reserves the right to establish, remove, and/or revise charges for any or all aspects of the Services at any time at Ecogadgets’ sole discretion. Ecogadgets will make reasonable efforts to inform you of applicable charges; however, you will be responsible for Charges incurred under your account regardless of your awareness of such charges or their amounts. We may, from time to time, provide certain users with promotional offers and discounts that may result in different charges for the same or similar services, and you agree that such promotional offers and discounts, unless also made available to you, will have no bearing on your use of the services or the charges applied to you. You may choose to cancel your request for services from a Third Party Professional at any time prior to the Third Party Professional’s arrival.
